1. Relationship to the Customer Agreement<\/span><\/h2>\n

These terms govern Authorised Users’ access to the elyXion<\/strong> Portal. The Customer’s Agreement controls commercial rights and takes precedence. Users access the Portal on behalf of the Customer and must follow Customer policies.<\/p>\n

2. Accounts and Access<\/span><\/h2>\n

Access is limited to named Authorised Users. Users must provide accurate information, protect credentials, use required multi-factor authentication, and report suspected compromise promptly. Shared accounts are prohibited unless expressly approved for a technical integration.<\/p>\n

Customer administrators control user invitations and roles where enabled. elyXion<\/strong> may verify authority before granting privileged access.<\/p>\n

3. Permitted Use<\/span><\/h2>\n

The Portal may be used to view service information, submit and track support, access documents, review assets, costs, risks, project status, recommendations, or other subscribed features. Users may use exported information for the Customer’s internal business purposes.<\/p>\n

4. Data Sources and Accuracy<\/span><\/h2>\n

Portal data may come from Customer input, elyXion<\/strong> records, Microsoft APIs, monitoring tools, ticketing systems, or other providers. Refresh cycles, permissions, service limitations, and API errors can cause delay or incompleteness.<\/p>\n

The Portal is not the system of record unless the Agreement expressly identifies it as such. Users should validate high-impact decisions against authoritative sources and seek advice where appropriate.<\/p>\n

5. Recommendations and Actions<\/span><\/h2>\n

Recommendations are informational and may reflect automated rules or AI assistance. They are not automatically suitable for every environment. The Customer remains responsible for approval, change planning, compliance, and business decisions. elyXion<\/strong> will not make a material production change solely because the Portal displays a recommendation unless pre-authorised.<\/p>\n

6. Availability and Changes<\/span><\/h2>\n

elyXion<\/strong> may improve, add, replace, or retire Portal features under the Lifecycle Policy. Preview features may change without notice and have no SLA. Planned maintenance and emergency security action may affect access.<\/p>\n

7. Integrations<\/span><\/h2>\n

Integrations require permissions that should be limited to the functions needed. The Customer authorises the configured access and must maintain required provider subscriptions and licences. Revoking permissions may reduce functionality.<\/p>\n

8. Customer Content<\/span><\/h2>\n

Users may upload tickets, files, comments, architecture material, contact details, and other content. The Customer warrants it has rights and lawful grounds to provide that content. Users should avoid unnecessary secrets, passwords, special-category personal data, or production datasets.<\/p>\n

9. Intellectual Property<\/span><\/h2>\n

elyXion<\/strong> and its licensors own the Portal, interface, software, documentation, designs, metrics definitions, and underlying technology. No source-code, resale, sublicensing, or derivative-work right is granted. Feedback may be used without restriction if it does not disclose Customer Confidential Information.<\/p>\n

10. Prohibited Behaviour<\/span><\/h2>\n

The Acceptable Use Policy applies. Users must not bypass role controls, scrape at scale, interfere with telemetry, upload malicious content, impersonate others, or attempt unauthorised access.<\/p>\n

11. Privacy and Monitoring<\/span><\/h2>\n

elyXion<\/strong> processes account, usage, support, and security data as described in the Privacy Policy and DPA. Security logs may record authentication, device, IP address, actions, and administrative changes. Monitoring is used to operate, secure, audit, and improve the Portal.<\/p>\n

12. Suspension and Termination<\/span><\/h2>\n

elyXion<\/strong> may suspend a user for security, misuse, legal, or account reasons. Customer administrators may remove users. At contract end, access ends and export\/deletion follows the Agreement and DPA.<\/p>\n

13. User Support<\/span><\/h2>\n

Portal issues should be reported through the available support route. Users should include screenshots only after removing unrelated personal or confidential information.<\/p>\n

14. Disclaimers<\/span><\/h2>\n

The Portal is a service-management aid and does not replace professional advice, Microsoft administrative portals, statutory records, emergency communications, or Customer governance. Preview, forecast, cost, security, and AI-derived information may contain errors.<\/p>\n\r\n\t\t<\/div>\r\n\t<\/div>\r\n<\/div><\/div><\/div><\/div><\/div>
